Program Overview

The 101 Perks Rebate Program (the “Program”), the website for the Program located at perks.uscreditcards101.com or another URL designated by US Credit Cards 101 from time to time (the “Site”), are owned by US Credit Cards 101 (“we,” “us,” “our,” “US Credit Cards 101”). The Program enables members of the US Credit Cards 101 community to earn cash rebates (“Rebates”) for qualifying applications and purchases of financial products and services made through the Site. “Participating Merchants” are financial institutions and service providers that participate in the Program by making available offers which, if accepted by US Credit Cards 101 Members (as defined below), enable such US Credit Cards 101 Members to earn Rebates.

Agreement Formation

These terms and conditions of service (the “Terms”) constitute a legally binding agreement between an individual who enrolls in the Program, uses the Site, or participates in rebate activities (“you” or the “US Credit Cards 101 Member”), on the one hand, and US Credit Cards 101 on the other hand. By participating in the Program and continuing to use the Site, you acknowledge that you have read and understood this Agreement and that you agree to be bound by all of its terms. Additionally, you acknowledge and have read the US Credit Cards 101 Privacy Policy, which may be viewed on our website. If you do not agree to all of the terms of this Agreement, or if you do not acknowledge the Privacy Policy, then do not continue to use the Site or participate in the Program. Participation in the Program is at the discretion of US Credit Cards 101.

Definitions

“We,” “Us,” “Our”: Refers to US Credit Cards 101 and the operators of this rebate portal.

“You,” “Your,” “US Credit Cards 101 Member”: Refers to the user or visitor of this website and rebate portal who has enrolled in the Program.

Purchase Requirements

Before making a purchase through our partner merchants, please disable all ad-blocking software and ensure cookies are enabled in your browser to ensure proper cashback tracking.

Please complete your purchase promptly after entering the merchant website. Visiting unrelated pages during the purchase process may result in the cashback not being tracked.

Fees

There is no fee to enroll in the Program or use the Site. Some of the Participating Merchants may charge fees with respect to some of their offers related to the Program. Any such fees will be disclosed in the description of those Participating Merchants' offers, and each Participating Merchant reserves the right to change such fees or institute new or additional fees in the future.

Program Rules

You agree to comply with this Agreement, and all other policies and rules as set forth in Program materials, including materials of Participating Merchants, either in print or on the Site (collectively, the “Rules”). The Rules, including any amendments that may be made from time to time, are hereby incorporated by reference into this Agreement. We may modify this Agreement or the Rules at any time. No other act, document, usage or custom will be deemed to amend or modify this Agreement. This Agreement and the Rules as so amended will be posted on the Site, and your continued use of the Program thereafter will constitute acceptance of any such amendment. If you do not agree to any amendment to this Agreement or the Rules, you must immediately cease accessing and using the Program and Site.

Prohibited Use

You agree that you will not, and will not permit others to:

  • provide any unauthorized third party with access to the Program, Site, or any information, data, text, links, images, software, chat, communications and other content available through the Program (collectively, “Content”) by any means;
  • modify, reverse engineer, reverse assemble, disassemble, translate, decompile or otherwise attempt to derive source code (in each case, in whole or in part) of any of the software applications used by you in connection with your participation in the Program;
  • engage in any activity that does not comply with U.S. law or other applicable law and regulations or otherwise engage in any illegal, manipulative or misleading activity through the use of the Program;
  • introduce into the Program any code intended to disrupt the Program, alter or delete its Content, access confidential Content on the Site, circumvent any technical restrictions of the Site, or interfere with the operation of the Program, including distribution of unsolicited advertising or mail messages and propagation of computer worms and viruses;
  • monitor or copy any Content by using any manual process, robot, spider, or other automatic device without US Credit Cards 101's consent;
  • take any action that will or could impose an unreasonable load on the Site infrastructure;
  • post any material in any form whatsoever on the Site or within the Program that is defamatory, obscene or otherwise unlawful or violates any third party's right of privacy or publicity;
  • infringe any third party's patent, copyright, service mark, trademark or other intellectual property right of any kind or misappropriate the trade secrets of any third party in connection with your use of the Program; or
  • use, copy, modify, distribute, sub-license, export, or otherwise transfer the Site, any related documentation, or the results obtained through use of the Site (in each case, in whole or in part).

Rebate Tracking and Processing

Once your application is approved, we usually receive confirmation within 2–4 weeks. If tracking is not recorded after this period, you may contact us for investigation.

In rare cases, your clicks and applications may not be tracked. The final determination shall be based on our system records.

We reserve the right to adjust cashback amounts at any time. The final amount shall be based on the amount actually received and confirmed by us.

User Account Responsibilities

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

Program Modifications

US Credit Cards 101 reserves the right to modify or discontinue the Program, rebate offers, or these Terms at any time without prior notice. Continued use of the Site after such modifications constitutes acceptance of the updated terms.

Limitation of Liability

US Credit Cards 101 shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of this service, including but not limited to loss of profits, data, or business opportunities.

Governing Law

The validity, construction and interpretation of this Agreement, and the rights and duties of the parties hereto, will be governed by and construed in accordance with the laws of the State of Delaware, excluding its conflicts of laws principles. The parties agree that neither the United Nations Convention on Contracts for the International Sale of Goods nor the Uniform Computer Information Transactions Act (UCITA) will apply in any respect to this Agreement.

Notice of Disputes

You agree that you will notify US Credit Cards 101 of any dispute by submitting concerns to [email protected], including a description of the nature of the dispute. Following delivery of such submission, you agree to allow US Credit Cards 101 a period of sixty (60) days to provide a substantive response and to try to resolve the dispute, prior to filing any lawsuit or any other proceeding against US Credit Cards 101 related to the dispute. YOU AGREE THAT FAILURE TO COMPLY WITH THESE NOTIFICATION PROCEDURES WILL ENTITLE US CREDIT CARDS 101 TO RECOVER FROM YOU REASONABLE ATTORNEYS’ FEES INCURRED IN DEFENDING THE LAWSUIT OR ANY OTHER PROCEEDING.

Class Action Waiver

YOU AGREE THAT THE RESOLUTION OF ANY DISPUTE, CLAIM, OR CONTROVERSY RELATED TO THE PROGRAM SHALL BE CONDUCTED ON AN INDIVIDUAL, NOT A CLASS-WIDE BASIS, AND THAT NO SUCH PROCEEDING MAY BE CONSOLIDATED WITH ANY OTHER LEGAL PROCEEDINGS INVOLVING US CREDIT CARDS 101 OR ITS AFFILIATED ENTITIES. YOU FURTHER AGREE THAT YOU, AND ANYONE ASSERTING A CLAIM FOR YOU, WILL NOT BE A CLASS REPRESENTATIVE, CLASS MEMBER, OR OTHERWISE PARTICIPATE IN A CLASS, REPRESENTATIVE, CONSOLIDATED OR PRIVATE ATTORNEY GENERAL PROCEEDING AGAINST US CREDIT CARDS 101 RELATING TO THIS AGREEMENT OR THE RULES.
